Partner Leean Chojnowski Leads Roundtable at LeadingAge Southeast Annual Convention

This month, Pennington, P.A. had the honor of sponsoring and participating in the 29th annual Tallahassee Bar Association Chili Cook-Off, benefiting the Legal Aid Foundation of Tallahassee. Our team had the best time visiting with so many members of our community, sharing an amazing new chili recipe, and presenting a country music-themed booth as a tribute to the late, great Dolly Parton. We are so proud to be an annual participant of this event. Thank you to the Tallahassee Bar Association for putting together such a wonderful evening and to the Legal Aid Foundation for their pivotal work in ensuring access to legal services for all.

Pennington shareholder Brian Chojnowski and associate Tanner Cohen recently secured a favorable ruling from the United States Court of Appeals for the Eleventh Circuit, which affirmed the dismissal of all claims against the firm’s clients and the denial of the plaintiffs’ multiple post-judgment motions. The appeal arose from a federal lawsuit asserting eighteen claims against numerous defendants. The district court dismissed the action with prejudice after finding that the plaintiffs’ amended complaint failed to comply with federal pleading requirements despite an opportunity to correct its deficiencies. The plaintiffs subsequently filed multiple post-judgment motions seeking to set aside the judgment, including motions for reconsideration, vacatur, relief from judgment, and a request for an evidentiary hearing, all of which the district court also denied. On appeal, the plaintiffs challenged these rulings on numerous grounds. The Eleventh Circuit rejected their arguments, finding that dismissal with prejudice was proper after the plaintiffs failed to correct the pleading deficiencies. The Court affirmed the district court’s judgment and denied all pending motions. The case arose from an alleged slip-and-fall incident at Joe’s Crab Shack. The plaintiff alleged that liquid on the floor created a dangerous condition that caused the fall and resulting injuries. At trial, Ben Andrews and Nicholas Lecakes argued that the evidence failed to establish that Joe’s Crab Shack had actual or constructive notice of the alleged liquid on the floor and, therefore, could not be held liable for the incident. Following the presentation of evidence and argument, the jury returned a complete defense verdict, finding no liability on behalf of the firm’s client. The verdict represents a successful result for the client and reflects the firm’s continued commitment to providing effective trial representation in premises liability matters throughout Florida.

Pennington congratulates Partner Derek Womack on securing a significant summary judgment victory in the United States District Court for the Northern District of Florida! The client in this matter was Camelot Schools of Florida, LLC, the operator of a public school in Santa Rosa County. The case arose from two incidents involving the involuntary examination of minor students under Florida’s Baker Act. Plaintiffs asserted various federal civil rights claims against Camelot and other defendants arising from the students’ removal from school and transport to a medical facility. The Court granted summary judgment in favor of Camelot and the other defendants, ultimately concluding that the restraint and transportation of the students by the school deputy was justified and did not impinge on any constitutional rights of the students or their parents as a matter of law. Similarly, the fact that the school did not notify one student’s parents prior to his restraint did not amount to a due process violation of the parents’ rights relating to the care, custody, control, or medical decision-making for their child. Congratulations to Derek and the entire defense team on an exceptional result for the client!

A recent decision from the Second District Court of Appeal addressed an important principle of Florida premises liability law: a visitor’s status is not necessarily fixed upon entering a property. Rather, a visitor’s status may change depending on where the visitor goes and what the visitor is doing at the time of injury. In SeaWorld Parks & Entm't LLC v. Abougamal, No. 2D2025-0588, 2026 WL 2651402 (Fla. 2d DCA Sept. 9, 2026), the minor plaintiff entered Busch Gardens as a ticketed business invitee and was permitted to enter a theater within the park. He later climbed onto a performance stage and a professional circus trampoline that was not intended for guest use and was injured while jumping off the trampoline. The Second District held that, by going beyond the scope of Busch Gardens’ invitation and using the area for his own entertainment, the plaintiff became, at most, an uninvited licensee at the time of injury. The visitor’s status at the time and place of injury matters because that status determines the duty owed by the landowner. While business invitees are owed a heightened duty of reasonable care, the duty owed to an uninvited licensee is lessened to avoid willful or wanton harm and, upon discovery of the licensee’s presence, to warn of known dangers not open to ordinary observation. Because there was no evidence that Busch Gardens breached this lesser duty, the Second District reversed the judgment for the plaintiff and remanded for entry of judgment in favor of Busch Gardens.

Pennington is proud to congratulate our own Madeline Huggins on being named to the U.S. National Swim Team! Maddy is a graduate of Florida State University and former member of the FSU swim team. She now continues to train professionally at Florida State while also working as a legal assistant with the firm. Her selection to the U.S. National Team reflects an extraordinary level of dedication, discipline, and athletic achievement. Balancing the demands of professional training with her work at the firm makes the accomplishment even more impressive. Those who work with Maddy know the focus, energy, and determination she brings to everything she does. We are proud to have her as part of the Pennington team and excited to see her accomplishments recognized on the national stage. Congratulations, Maddy. The Pennington team hit the lanes this week for our annual bowling competition. It was a fun chance to unwind, spend time together out of the office, and see who takes bowling a little more seriously than they let on. Congratulations to shareholder Michael Thomas, who took home the top score of the night and showed his skills extend well beyond the courtroom.  Overall, it was a great night with an even greater group, and we’re already looking forward (and training) for the next firm outing.
